On announcing multi-band bidding (sequential) auctions for obtaining radio frequency spectrum licenses for terrestrial systems capable of providing electronic communications services

Georgian National Communications Commission (hereafter: the Commission) notes, that in accordance with Article 472of the Georgian law “on Electronic Communications” and European Commission Resolutions - 2010/267/EU, 2012/688/EU and 2011/251/EU, regarding  the technical conditions developed by CEPT (The European Conference of Postal and Telecommunications Administrations) Commission resolutions № 1 of June 12, 2015, and  № 11 of November 10, 2015on “"National Radio Frequency Allocation Plan" on amendments to the Commission Decree №6 of June 30, 2006”,  have caused relevant amendments to  the "National Radio Frequency Allocation Plan."

 

The Commission notes, that having regard to the requirements of Articles 472  and 473of the Georgian law “on Electronic Communications” the modification  in accordance with the principle of technological neutrality and  15 year term has been made to   the licenses for the use of the radio frequency spectrum in  900MHz, 1800მMHz and 2100 MHz bands;

 

The Commission notes, that in compliance with  the requirements of the Georgian law “on Electronic Communications”  “Magticom” Ltd waived 838.365-842.055 MHz and 883.365 - 887.055 MHz frequency range in 800 MHz band defined by F1 license - and 2X15 MHz resource in 2100 MHz band;

         

          As a result of the foregoing,  radio frequency resources became available in 800/900/1800/2100 MHz bands , in particular,  2X20 MHz - in 800 MHz , 2X4,5 –in 900 MHz, 2X5 MHz – in 1800 MHz and 2X15 MHz –in 2100 MHz bands.

         

          The Commission, also notes, that “Magticom” Ltd has addressed the Commision in a written form (№6/5893-15 17.08.2015; №6/6385-15 31.08.2015; №7/5233-15 27.07.15 №6/8767-15 13.11.2015) with a request to announce the auction in harmonized 800 MHz band.

 

   The Commission, on its hand, on July 19, 2015, published a document (http://gncc.ge/uploads/other/1/1347.pdf), which depicts Commission’s vision on conducting the auctions (2nd phase) of wireless broadband terrestrial systems in harmonized (800/900/1800 MHz and 2100 MHz (paired)) frequency bands and its approach towards other candidate bands. Also, the consultation document  (http://gncc.ge/uploads/other/1/1550.pdf)  defines views of the Commission and of interested parties in relation to the conduct of the auctions in 800/900/1800 MHz and paired 2100 MHz bands.  The aim of an above-noted document was to inform, beforehand, potential investors at local and international levels about planned auctions, as well as prior identification of the existing demand towards the resources available in  800/900/1800 MHz and paired 2100 MHz bands (on local and international levels), obtaining of opinions of interested parties regarding the conduct of the auctions, to analyze, respond and to  introduce Commission’s possible future vision/approach towards other candidate (700 MHz, 1,5 MHz, 2.3MHz) bands to all interested parties. 

 

On November 3, 2015, the Commission, having regard to the argumented views and with an active involvement of interested parties, adopted resolution № 10 on making amandements to the Commission’s resolution N13 of December 12, 2005, on “conducting auction for the right of use of Radiofrequency Spectrum and/or Numbering resource” which defined terms and conditions for the conduct of the multi-band bidding (sequential) auctions for obtaining radio frequency spectrum license/licenses in the scope of radio frequency ranges carrying specific and/or similar characteristics.

 Also, in addition, the Commission notes, that in order to identify possible interferences in the available bands, GNCC’s Radio Frequency Management Department studied existing situation in the 20th band (791-862MHz frequency band) for the blocks dedicated for LTE technology (downlink and uplink), as well as  the impact of CDMA technology implemented in Duplex Gap of the range noted.  Test measurements were carried out on January 14-15, using Commission’s own  “Rohde&Schwarz TSMW” frequency spectrum analyzer and software complex of “ROMES.” For the measurement, an existing place in Kutaisi (geographical coordinates E42o41’34.8”, N42o15’00.4”) was selected, where receivers  and transmitters of mobile, as well as of the wireless fixed network  operators ( “Magticom” Ltd, “Geocell” Ltd, “Mobitel” Ltd, “Silknet” JSC) are concentrated. Test measurement results and recommendations were sent to the network operators currently operating within Georgian mobile market via electronic mail and in the written form.

                      The Commission notes, that there are possible interfering circumstances for the proper operation of the mobile networks using frequencies in 800 MHz band. The problem exists due to the JSC “Silknet”’s F11 license for CDMA 850 technology. The fixed and mobile communications services is being provided to 66 855 subscribers (4th quarter of 2015) by means of the resources of the above-mentioned license. It should be taken into consideration, that,  the problems may occur, on one hand, to the license seekers, who, after winning the auction and obtaining the license in 800 MHz band will launch the 4th generation of broadband telecommunications services, and on other hand, to the company “Silknet” JSC itself. Based on international study, it might be concluded, that specifically, the interferences are to be expected in Up-link 832-837, Down-link 791-796 and Up-link 857-862, Down-link 816-821 bands, Down-link 816-821 bands, because in general, 821-824 MHz range forms a border zone between the downlink of LTE 800 and Up-link of CDMA 850;

                      Also, border between CDMA 850 Up-link and LTE 800 layes on 832 MHz frequency band; 862-869 frequency band forms a border zone between LTE 800 Up-link and CDMA 850 down-link. CDMA base station transmission may cause the negative impact on GSM / UMTS base station receiver tract and vice versa.

 

            Sub-paragraph c) of paragraph 3 of Article 473of the Georgian law “on Electronic Communications” takes into consideration the Commission right, insteadof the relevant compensation, to request from the licensee full or partial waiver of the existing license for the use of radio frequency spectrum, in accordance with  technical norms and standards of the harmonized ranges, for the purpose of planning and allocation, while making such changes in the "National Radio Frequency Allocation Plan" that make it impossible to maintain the co-existance of  the technical norms and standards of existing, newly planned or allocated radio frequencies, as well as, the co-existance of communications technologies. In compliance with the above-noted norm of the law, in accordance with the sub-paragraph c) of paragraph 3 of Article 473   of the Georgian law “on Electronic Communications,” the amount of the compensation, terms and form of the payment shall be defined by the Commission’s decision, with aconsent of the Government of Georgia. In line with the above-mentiond, the Commission considers, that in compliance with the requirements of sub-paragraph c) of paragraph 3, of Article 473of the Georgian law “on Electronic Communications,” instead of the relevant compensation, the issue on cancellation of the №F11 license of “Silknet” JSC for the use of the radio frequency spectrum shall be agreed with the Government of Georgia. 

                     

                      The Commission considers, that for the purpose to create competitive, transparent and predictable investment environment for mobile/wireless market (which is the main purpose of the Regulator) it is necessary to bring out the resources available in the radio frequency bands for wireless / mobile broadband systems with same and/or similar characteristics in the auctions all at once. This will allow the existing market participants, as well as the new entrants (if any,) to adequately define their business model and to obtain the desired resources within a maximum number of radio frequency resources (so-called „Spectrum Cap”) set by the Commission.

 

The Commission notes, that in accordance with the European Commission resolutions (2010/267/EU, 2012/688/EU and 2011/251/EU) it is recommended, to assign radio frequency resources in 5 MHz blocks; The Commsission also notes, that, since only 2X4,5 MHz resource is available in 900 MHz and 2X5 MHz resource in 1800 MHz  band – available resources in these bands shall come out in the auctions in  independent form; As for the resources available in 800 MHz and 2100 Mhz bands, despite the fact, that in given situation it is possible to bring together more than 2x5 resource (5 MHz blocks ), the Commission considers, that it is more appropriate to put out 2x20 MHz available resource in 800 MHz range and 2x15 available resource in 2100 MHz range in the auction in the form of 2x5Mhz blocks, which will allow participants to act flexible in order to ensure defined business model in terms of acquiring the necessary resources.

 

The Commission notes, that in order to ensure the access of licensees to the adjacent (sequential) blocks, it is convenient to put out two 2x5 MHz (832-837 and 791-796  MHz;   857-862 and 816-821 MHz) frequency bands  in 800 MHz range, in the form of specific blocks  in the auction; as for the two 2x5 MHz (837-847  and 796-806  MHz) frequency bands – in the form of abstract blocks; also, three 2x5 MHz frequency bloks (1935-1950 MHz and 2125-2140MHz) available in 2100 MHz – in the form of abstract blocks.

Based on above-noted, the Commission considers, that with a regard to the results of the auction, the access of the licensee to adjacent (sequential) frequency resource shall be ensured under following terms and conditions:

  • For the auction participant, who will obtain the license for any of the specific block in 800MHz range and the license for  any of  the abstract block at the same time, the Commission shall ensure the access of this person to the adjacent block of the acquired specific block;
  • If the specific block obtained is in 857-862 and 816-821MHz ranges, the Commission shall ensure the negotiation with “Mobitel” Ltd, in connection to the shifting of bands held by the company, in order to free adjacent block of 857-862 and 816-821MHz ranges.

The Commission notes that while defining coverage obligations, consideration should be given to the characteristics of the band and to the position held on the market by the winning bidder (existing mobile operator and the new entrant).  The Commission considers that the obligation for the coverage of so-called "Service-deficient" regions shall be defined for the licenses in 800 MHz within a reasonable period of time. The Commission also notes, that since 800 MHz range, just  like other low-frequency ranges, in terms of signal propagation and building penetration (which is inexpensive (less sites) in terms of area coverage) carries better characteristics in comparison to the high-frequency (1800/2100 MHz) ranges, it is used for ensuring an adequate level of coverage on a national level. Based on above-noted, the Commission considers it appropriate, in the scope of the present auction, to establish following coverage obligation:

 

a)  If, by the time, when the auction is being carried out the winning company already holds or by winning the auction becomes a holder of 2x30 MHz frequency resources or more in 800/900/1800MHz bands, jointly, it shall ensure access to mobile / wireless broadband services in populated areas of Georgia (Primary territorial unit of the settlement that has a name, administrative boundaries, territory and has a registered population), where the number of inhabitants is less than 5000, according to the latest census of the population provided in 2014 or later, and pursuant to the following table:

b) If the auction winner becomes the holder of less than 2x30MHz frequency resource in 800/900/1800MHz frequency ranges, jointly, the winner shall ensure the access, of population of Georgia, to the services (excluding occupied territories) pursuant to the following table:

c) If, by the time, when an auction is being carried out the winning company already holds or by winning the auction becomes a holder of 2x20MHz or more frequency resources in 800/900 MHz bands, jointly, holder of an above-mentioned license shall ensure the availability of mobile/wireless services in the administrative centers of protected areas of Georgia, in visitor centers and ranger centers (see in the form of Annex №1 the list of 79 centers provided by the Agency of Protected Areas of Georgia, including coordinates), steb-by-step,within 2 years after obtaining the license.

The Commission notes, that in all three a) b) c) cases, as a licensing term (obligation), a minimum service delivery, stable accessible quality shall be determined; in particular, spectral efficiency (measured units- Bits / sec / Hz and bits / sec / Hz /cell) in accordance with characteristics provided in technical documents of ETSI TR 136 912  V.13.0.0 (2016-01) and TR 136 913  V.13.0.0 (2016-01) in a case, if a licensee provides services using LTE technologies.

 

 

      In addition, the Commission notes, that in accordance with paragrapf 3 of Article 50 of the Georgian law “on Electronic Communications,” for the purpose to ensure competition in the field of electronic communications, in compliance with the Commission’s argumented decision, the right to use radio frequency spectrum shall be restricted to the person, who independently and/or with interdependent (affiliated) persons,  in case of winning the auction, with the combination  of specific section of the radio frequency band (radiofrequency range) or the specific sections of the radio frequency bands carrying similar characteristics ,  will become the owner of more than  the maximum amount of radio frequency resources, as defined by the Commission’s decision on announcing the auction.

 

In the scope of the present auction, within the framework of the legal norm, the Commission shall make a fair and argumented decision in connection to the maximum amount of radio frequency resources to be determined, with regard to the management of radio frequency resources in terms of international practice and current situation of Georgia in terms of allocation of radio frequencies on the market.

The Commission, also notes, that during consultation period, “Mobitel” Ltd and “Geocell” Ltd, have presented their positions in regard to the maximum amount of radio frequency resources to be determined within a scope of the auction. The letter (registered in the Commission №6/4737-15, 14.07.2015) submitted by “Mobitel” states: “We believe, that so-called “cap” of “Mobitel” Ltd in the 800 MHz frequency band should be defined as 5MHz. In addition, companies “Magti” Ltd and “Geocell” Ltd should be restricted to participate in upcoming auctions for 900 MHz, 1800 MHz, 2100 MHz frequency ranges, due to holding of excessive number of frequencies in the above-mentioned bands.” The letter (registered in the Commission №6/4737-15, 14.07.2015) submitted by “Geocell” notes: “despite the fact, that operators had an opportunity to maintain frequency resources in 900, 1800 and 2100 MHz ranges, the same does not apply to 700 and 800 MHz frequencies. Geocell offers to determine a Spectrum Cap in the amount of 2x10MHz for both, 700MHz and 800MHz ranges.”

 

The Commission, also notes, that the aim of the assignment of radio frequency resources is to satisfy the growing demand for mobile/wireless broadband services and to ensure the availability of broadband services in the service - deficient regions; meaning availability of frequency resources within technically-economically effective, low-frequency (below 1 GHz) harmonized bands, necessary for functioning of network, as well as, facilitation of the competition on infrastructure level.

 

The Commission considers, that in technical terms, 800 MHz and 900 MHz bands have interchangeable / similar characteristics; due to which, in order to promote the long term competition at infrastructure level  on mobile/wireless market, it is recommended, that the maximum amount of radio frequency resource should be defined for the combination  of  800 MHz and 900 MHz frequency bands.

 

Based on above-mentioned, the Commission considers it appropriate, within a scope of the present auction, to determine such type of the maximum amount of the radio frequency resource, which will restrict an entity from participating in the auction, if by the time when the auction is being held, an entity already owns or by winning the auction becomes the owner of more than 2x25 MHz available resource within existing 800 MHz and 900 MHz bands. 

 

At the same time, the Commission notes, that in order to satisfy the growing demand and to ensure an adequate capacity, in the nearest future, the Commission plans, for mobile/wireless services, to make available above 1GHz European harmonized bands for wireless broadband services. Therefore, in compliance with supply-demand trends on radio frequency resources, in order to promote the development of high quality mobile broadband services, for the unity of all the radio frequency bands carrying same characteristics, there is no need to establish maximum amount of radio frequency resource (so-called Overall Spectrum Cap) in order to promote competition,. 

 

The Commission considers, that the  auction conducted  with  regard to the above-noted maximum amount of radio frequency resources will maintain an existing minimal level of competition on the mobile/wireless market (3 operators) and during the auction the moderate competition will be ensured among the participants. At the same time, mobile operators will have an opportunity to develop network with radio frequency resources available in the bands below 1GHz, which is extremly important in order to ensure the coverage of country’s regions and remote areas. 

 The Commission notes, that in accordance with paragraph 1 of Article 9 of the Commission resolution №13 of December 12, 2005, on “conducting auction for the right of use of Radiofrequency Spectrum and/or Numbering resource”   it is determined, that an initial price for auctioned radio frequency resources for obtaining the licenses for terrestrial systems capable of providing electronic communications services shall be defined on the basis of  estimated value of 1 MHz resource of an appropriate radio frequency band using benchmarking and/or business model methodologies via  following formula: P= Pn*C-B , where P- is an initial price of radio frequency resource in Georgian Lari; Pn – an estimated value of 1MHz for the specific unit of the radio frequency band according to benchmarking and/or business model methodology; C -  an amount of auctioned radio frequency band units (MHz); B – an estimated value of auctioned radio frequency spectrum determined by the Commission (Pn*C) resolution on the announcement of the auction with a discount of 5% to 20%, determined based on existing demands on the market and licensing terms. Therefore, during the announcement of any specific auction, the Commission has an option, based on specific demands and obligations defined for a specific license to determine a discount of 5% to 20% and calculate an initial price for the use of the appropriate resources.

In accordance with the paragrapf 2 of the same Article, in the case, if the price estimation of 1MHz of the specific block is being calculated based on benchmarking and business model methodologies, business model methodology shall have an advantage while determining the initial price for the usage of radio frequency spectrum.

 

In addition, Commission notes, that in a scope of an electronic tender (SPA140019263) announced on August 12, 2014, with a regard to the tender requests, the winner company (“PricewaterhouseCoopers Central Asia and Caucasus B.V. Georgia Branch”) using business model methodology, carried out the estimation of 800 MHz, 900 MHz and paired 2100 MHz ranges and determined the initial price of 1MHz resource (rounded up to the whole number):

 

a) Estimated market value of 1MHz in 800 MHz range - 2 545 494 (two million five hundred forty-five four thousand and ninety-four)

b) Estimated market value of 1MHz in 900 MHz range - 2 469 267 (two million four hundred sixty - nine thousand two hundred and ninety-four) GEL;

c) Estimated market value of 1 MHz in 1800 MHz range - 1 423 785 (one million four hundred twenty-three seven thousand eighty-five) GEL;

d) Estimated market value of 1 MHz in paired 2100 MHz range - 863 088 (eight hundred thousand sixty-three and eighty-eight) GEL;

 

Based on the above-mentioned, the Commission believes, that an initial price of available auctioned licenses shall be calculated using the formula provided in accordance with paragrapf I of Article 9 of the Commission resolution №13 of December 12, 2005, based on an estimated value of 1 MHz evaluated by business modeling methodology, where assumed discount of the radio frequency resource price shall be at least – 5%. e.e) ensure spectral efficiency in accordance with the present decision defined for the populated areas and the administrative centers of protected areas of Georgia, as well as for visitor centers and ranger centers (in measured units - Bits / sec / Hz and bits / sec / Hz /cell) in accordance with the characteristics set in the technical documents of ETSI TR 136 912  V.13.0.0 (2016-01) and TR 136 913  V.13.0.0 (2016-01)in the case, if, the licensee provides services using LTE technology.

 

Note: service availability in the settlements is continuous supply of quality services for the 100% of the population registered within the administrative boundaries of the settlements;

e.f) If requested, the licensee shall ensure compliance with Radio Regulations of the International Telecommunications Union on international coordination and cross-border co-ordination and sharing procedures defined under bilateral agreement of the Commission with neighboring countries;

 

e.g) provide the Commission with information about the locations of the base stations ( geographical coordinates), the antenna height, antenna type, tilt angle and direction (azimuth), as well as information about frequency band(s) used by each base sation;

e.h)  ensure coordinated use of radio spectrum with an adjacent block licensee, in order to avoid interference;

e.i) In case of interferences of the network implemented in the range of 827.955-831.645MHz and 872.955- 876.645MHz bands, ensure the elimination of such interferences. The elimination of interferences shall be in force until the Commission decision on cancellation of F11 license of “Silknet” JSC for the use of radio frequency spectrum license in accordance with Article 473   of the Georgian law “on Electronic Communications,” in agreement with the Government of Georgia, is made;

e.j) ensure the availability of electronic communications services to at least 50% of the Georgian population (excluding occupied territories) within 2 years after obtaining the license by means of resources defined in the license;

e.k) (An additional term for the licensees in 800/900/1800/2100 MHz band existing on the market) ensure the availability of electronic communications services to at least 90% of the Georgian population (excluding occupied territories) within the resources defined in the license and resources owned by the licensee in 800/900/1800/2100 MHz bands, by means of implemented 1 or more wireless technologies (terrestrial system), jointly, within 3 years after obtaining the license shall;

e.l) (An additional term for the newly entrant licensee(who do not hold frequency resources in 800/900/1800/2100 MHz band) ensure the availability of electronic communications services to at least 90% of the Georgian population (excluding occupied territories) within the resources defined in the license and in the scope of the resources owned by the new entrant in other liberalized bands, by means of implemented wireless technology (terrestrial system), jointly, within 5 years after obtaining the license;

e.m) Immediately after the establishment of the relevant conditions, within the territories defined in the Georgian law “on Occupied Territories,” the Commission is authorized to define additional date and terms to the licensee in order to ensure coverage obligations;

2.   To announce №2 auction for obtaining the frequency spectrum license for electronic communications services carried out by terrestrial systems. The license terms shall be as follows:

a) Frequency spectrum: 10 MHz (2X5 MHz) frequency resource, within 837-847MHz and 796-806 MHz resources;

e.h)(An additional condition for the new entrant licensees (who do not hold frequency resources in 800/900/1800/2100 MHz ranges) ensure the availability of electronic communications services to at least 90% of the Georgian population (excluding occupied territories), within the resources defined in the license and the resources owned by the new entrant in other liberalized ranges, by the means of implemented wireless technologies (terrestrial system), jointly, within 5 years after obtaining the license   ;

e.i) Immediately after the establishment of the relevant conditions within the territories defined in the Georgian law “on Occupied Territories,” the Commission is authorized to define additional date and terms to the licensee, r in order to ensure coverage obligations;

6. To announce 6 auction for obtaining radio spectrum license for terrestrial systems capable of providing electronic communications services. The license terms shall be as follows:  

 

a) Radio frequency spectrum: 10 MHz (2X5 MHz) frequency resource, in the scope of  „downlink“ 1805.0-1880 MHz and „uplink“ 1710-1785 MHz resources;

Note: For the purpose to ensure access of the licensee on adjacent (sequential) frequency blocks, the specific frequency resource relevant to 2X5 MHz frequency block available by means of a license (out of 837-847  and  a796-806 MHz frequency resources)  shall be defined in accordance with the results of the auction, by  the resolution on issuance of the license.

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 24 182 193, 00 (twenty-four million one hundred eighty-two thousand one hundred ninety-three and 00) GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number , that is  1 209 10,00 ( one million two hundred nine thousand one hundred ten thousand and 00) GEL;

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

12. Following terms and conditions shall be defined for the auction №3,  announced  under paragraph three of the given decision::

 a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 24 182 193,00 (twenty-four million one hundred eighty-two thousand one hundred ninety-three and 00)GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number, that is  1 209 110,00 ( one million two hundred nine thousand one hundred ten thousand and 00) GEL;

 

b) Auction date shall be May 31, 2016, at 12:00;

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

13.  Following terms and conditions shall be defined for the auction №4,  announced  under paragraph four of the given decision::

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 24 182 193,00 (twenty-four million one hundred eighty-two thousand and one hundred ninety-three and 00)GEL; An auction bid shall be 5% of the reserve price of the license rounded to the whole number, that is 1 209 110,00 (one million two hundred and nine thousand and 00)GEL;

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

14. Following terms and conditions shall be defined for the auction №5,  announced  under paragraph five of the given decision::

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 21 112 232. 85(twenty-one million one hundred twelve thousand thirty-two hundred and 85)GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number - 1 055 612,00 (one million fifty-five thousand and six hundred and twelve thousand ) GEL;

 

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

15. Following terms and conditions shall be defined for the auction №6,  announced  under paragraph six of the given decision::

a) The  initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 13 525 957.50(thirteen million five hundred twenty-five thousand and nine hundred forty-seven thousand and 50)Gel; An auction bid shall be 5% of the initial price of the license rounded to the whole number, that is- 676 298.00 ( six hundred seventy-six thousand two hundred ninety-eight hundred  and 00) GEL;

 

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

16. Following terms and conditions shall be defined for the auction №7,  announced  under paragraph seven of the given decision::

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 8 199 336.00 (eight million one hundred ninety-nine three hundred thirty-six and 00)GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number, that is 409 967.00 (four hundred and nine thousand nine hundred sixty-seven and 00) GEL;

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

17. Following terms and conditions shall be defined for the auction №8, announced under paragraph eightof the given decision::

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 8 199 336.00 (eight million one hundred ninety-nine thousand three hundred thirty-six thousand and 00) GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number, that is 409 967.00 (four hundred nine thousand nine hundred sixty-seven and 00) GEL;

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

18. Following terms and conditions shall be defined for the auction №9, announced under paragraph nine of the given decision:

a) The initial price of the radio frequency resource envisaged by the auction shall be determined in the amount of 8 199 336.00 (eight million one hundred ninety-nine thousand three hundred thirty-six and 00) GEL; An auction bid shall be 5% of the initial price of the license rounded to the whole number, that is  409 967.00 (four hundred and nine thousand nine hundred sixty-seven and 00) GEL;

b) Auction date shall be May 31, 2016, at 12:00; 

c) Applications of license seekers shall be submitted on May 13, 2016, before 5 pm;

 

19. In accordance with the given decision, the right to participate in the auctions №1, №2, №3, №4 and №5 shall be restricted to the person, who independently and/or with interdependent (affiliated) persons already holds, or in case of winning the bid, will become a holder of more than 2x25 MHz spectrum within the available 800 MHz and 900 MHzranges. 

 

 20. The auctions, announced under the given decision, will be held in accordance with the provisions of the Commission Decision №13 on “Rights to hold an auction to use radio frequency spectrum and / or to obtain the right for the use of numbering resources”, approved on December 12, 2005. Based on rules defined in the provision on

 

21. In order  to participate in the multi-band bidding (sequential) auctions with the purpose to obtain license/licenses for the use of radio frequency resources within  available spectrum resources of the specific spectrum band (radio frequency range), or the specific spectrum band(s) (radio frequency ranges) carrying similar characteristics, the license seeker,  shall submit to the Commission the written application, which shall contain a reference specifying in how many auctions, announced for obtaining the license for the right to use  radio frequency spectrum, the applicant requests to participate;

 

22. The application of the license seeker shall enclose:

a) For the legal entities of the private law and sole proprietors -the statement from the state registry; For the natural persons – copies of identification documents stipulated by the Georgian legislation.  Application of Legal entity of public law shall enclose the authorized copies of incorporation documents. The application shall also, contain a certificate of authorization of a representative of license seeker or of a reperesentative of legal entity, indicating all the specifications of authorization of which the representative is equipped for the participation in the auction.  (   The documents submitted by the  natural person or a legal entity registered in another country and  participating in the auction,must be translated into Georgian and  duly authorized).

b) Document verifying the payment of license fee (1000 GEL) corresponding the number of auctions a license seeker requests to participatein.. The amount noted is being transferred to the state budget of Georgia (in order to obtain the relevant bank requisites of the State budget of Georgia, interested parties canaddress Commission's financial department at: +995 32 239 40 29);

 

c) Document verifying the payment of 10% (B) of the initial price, which shall be sufficient to cover 10% of the initial price of the scarce resources defined under the relevant  license/licenses envisaged in case of the applicant’s possible victory.  The amount noted shall be transferred to the account of the Commissio, namely: JSC "TBC bank" with the following requisites:

In case of the applicant’s victory in the auction, 10% (B) of the initial price shall be transferred to the State Budget of Georgia;

 

23. The issues regarding the refund of the license fee and the fee of 10% (B) of the initial price, is defined under the Commission decision on the “ Rights to hold an auction to use radio frequency spectrum and / or to obtain the right for the use of numbering resources” approved by the Commission’s decree №13 of December 12, 2005, ;

 

24. The Commission shall check the conformity of the documents submitted by the license seeker with auctions terms and conditions, within 3 working days after receiving applications. In case documentation is not submitted properly, the Commission shall define additional time of 5 working days to the license seeker, in order to ensure compliance of the documents with the established requirements. In case license seeker, during the additional timeframe, fails to submit the documentation, or submits noncompliant documents the Commission, at the auction session,  shall make a decision on dismissing the application and  refusal to the participation in the auction;

 

25. The payment of the 30% of the price for the usage of the resource shall be made within 1 month after the decision regarding the winner of the auction is announced. In the case of failure to pay the 30% of the price for the usage of the resource within 1 month period, the Commission shall make a decision on the refusal to issue the license. The winner shall submit a document confirming the payment of 30% of the price for the usage of the resource to the State Budget of Georgia to the Commission, within 2 working days after making the payment. The Commission shall make a decision on the issuance of the license to the winnier within 5 working days from the submission of the confirmation document regarding the payment of 30% of the price for the usage of the resource to the State Budget of Georgia. The rest of the payment shall be made within the first year of the license validity period, according to the rules defined by the decision of the Commission on issuance of the license to the winning bidder, whereby the licensee is obliged to present to the Commission the document verifying every new payment to the State Budget of Georgia within 2 working days.    

 

26. Annex №1 of the Commission’s given decision shall be approved;

 

27. Press Secretary of the Commission (Kh. Kurashvili) shall be entrusted with the provision of information;

 

28. The decision may be appealed at Administrative Cases Panel of Tbilisi City Court (address: David Agmashenebeli Alley, 12th kilometer, 6, Tbilisi) within one month period;

 

29. The decision shall take effect upon publication on the Commission's website (www.gncc.ge)

 

30. The control on the fulfillment of theprovisions of the noted decision shall be entrusted upon the Commission’s administrative department (I. Kharebava).
