Commission’s Decision Remained in Force

The Georgian National Communications Commission’s decision remained in force by Tbilisi City Court’s decision.

Radio Maestro (Georgian Radio Ltd) appealed against the Commission’s Decision regarding the company’s two-year restriction on participation in competitions for broadcasting licenses.

We remind you that Radio Maestro was announced the winner of the competition for the radio broadcasting license held in Gudauri on February 25, 2013. The company had to pay 20 % (344.25 GEL) of the license fee within one month after receiving the certified copy of the Decision on winning in the competition. However, Georgian Radio Ltd has not submitted the documentation confirming payment of the license fee to the Commission within the time limit defined by the Law.

The Commission officially sent the Decision N117/10 of February 25, 2013 on announcing the winner of the competition in Gudauri to Georgian Radio Ltd. According to the information submitted to the Commission by Georgian Post Ltd the mentioned post was delivered to Georgian Radio Ltd on March 20, 2013.

In accordance with the Law of Georgia on Broadcasting the Commission made a decision to refuse to issue the license because of non-payment of 20% of the license fee within the time limit defined by the Decision. In accordance with the same Law, Georgian Radio Ltd was limited to participate in competitions for broadcasting license for two years.

The mentioned Decision was appealed by Radio Maestro in Tbilisi City Court. The Court decided the Georgian National Communications Commission’s Decision of May 2, 2013 to remain in force. Georgian Radio Ltd will not be able to participate in competitions for broadcasting licenses during two years.
