GNCC has issued written warnings on entities authorized for transit of broadcasting “TV Kakheti” Ltd and “Cinema Kakheti” Ltd due to the illegal re-transmission of several channels, as for “Gorda” Ltd, the company has been given a fine in the amount of 3 000 Gel.

“TV Kakheti” Ltd has been transmitting following channels without proper licenses and permits: “Imedi,” “1^st Channel of the Public Broadcaster,” “Rustavi 2,” “Ertsulovneba,” “Maestro,” TV 11,” “2^nd Channel of the Public Broadcaster,” “Comedy Channel,” “Obieqtivi,” “Marao,” „Охота и рыбалка,” “Enki-Benki,” “Наше Кино,” “Авто+,” “Усадьба,” and “Stereo +.”

As for “Cinema Kakheti” Ltd, the company re-transmitted following channels illegally: “1^st Channel of the Public Broadcaster,” ” TV 11,” “Ertsulovneba,” “Kartuli Arkhi,” “2^nd Channel of the Public Broadcaster,” “Iveria,” “Футбол 2,” “Discovery science,” “Discovery,” “National Geographic,” “Animal Planet” and “ОРТ.”

“Gorda” Ltd has been re-transmitting 2 TV channels illegally: “TV 3” (Russian) and “РЕН ТВ.”

The Commission, during the process of studying and examining the merits of these issues, with an assurance of the participation of the parties, has considered, that all of these three companies have breached Berne Convention for the Protection of Literacy and Artistic Works, the WIPO Copyright Treaty and the Georgian laws “on Copyright and Related Rights” and “on Broadcasting.” In accordance with the Commission’s decision, all of these three legal entities have been assigned to terminate an illegal re-transmission of the above-mentioned broadcasting channels.
