The Commission has issued a written warning on “Magticom” Ltd and has sanctioned “Mobitel” Ltd (Beeline) and “Geocell” Ltd in the amount of 30 000 Gel

GNCC has issued a written warning on “Magticom” Ltd due to the absence of properly executed written contracts between end-users (subscribers), as for “Mobitel” Ltd (Beeline) and “Geocell” Ltd, they have been sanctioned in the amount of 30 000 Gel.

Commission’s Broadcasting Regulation Department has carried out a monitoring on subscriber SIM cards control purchases between “Magticom” Ltd, “Geocell” Ltd, “Mobitel” Ltd and so-called “dealers.” The monitoring has revealed, that “Magticom,” “Geocell” and “Mobitel” have been providing mobile telephony services to the subscribers without any written contracts.

In accordance to Article 62, paragraph 42, of the Georgian law “on Electronic Communications,” the provider of electronic communications services is obligated to provide its subscriber with services based on agreements in compliance with established standards. Given, that during a year, as envisaged in Article 45 of the Georgian law “on Electronic Communications,” no liability of any type has been used on “Mgticom” Ltd for similar violation, therefore, the company has been sanctioned in the form of a written warning. As for “Mobitel” Ltd and “Geocell” Ltd, due to continuous breaches, in accordance to Article 45, paragraph 1 of the current law, the companies have been sanctioned in the amount of 30 000 Gel.
