Commission has issued a written warning on “Georgian Central Communications Corporation” Ltd for violation of Copyright and Related Rights and has suspended authorization of broadcast transit of „TECHNOMAX LLP” Ltd due to continuous breaches

Commission has issued a written warning on “Georgian Central Communications Corporation” Ltd for violation of Copyright and Related Rights and has suspended authorization of broadcast transit of „TECHNOMAX LLP” Ltd due to continuous breaches.

“Georgian Central Communications Corporation” Ltd and „TECHNOMAX LLP” Ltd, companies that jointly offer services of broadcast transit to subscribers, were unable to present documentation proving legal transit of numerous broadcasting channels. 

 Prior to suspension of broadcast transit services, the Commission has imposed sanctions on „TECHNOMAX LLP“ Ltd numerous times. In the beginning, company has been sanctioned in the amount of 5 thousand GEL in accordance with Article 1441 of the “Code of Administrative Offences” for the provision of electronic-communications services without valid authorization and license. Later, the company carried out an authorization of broadcast transit at GNCC, however, „TECHNOMAX LLP“ Ltd has been sanctioned for the violation of Copyright and Related Rights twice, since, the documentation presented to the Commission related to the proof of registered offshore company documents proving ownership of the copyright and related rights turned out to be invalid on the territory of Georgia. The complaints related to the violation of Copyright and Related Rights by above-mentioned company are also submitted to the Commission by current operators, by the companies holding primary rights for re-transmission of relevant broadcasting channels and by the foreign channel dealer companies as well: “Silknet “JSC, “Caucasus Online” Ltd, “Georgian Cable Network Union” Ltd, “Euro News”, “National Geographic”, “Discovery” and others.
