Changes have been made in the Georgian law “on Broadcasting” on a basis of the Commission’s legislative proposal

The Parliament of Georgia has made changes in the Georgian law “on Broadcasting” based on the Commission’s legislative proposal, according to which, the Commission’s  discretion has been determined  when issuing a sanction in a case of violation of norms defined by the law.

In accordance with the previous edition of the Georgian law “on Broadcasting,” in case of detection of violation of the law by a broadcaster, after reviewing an issue, the Commission was obligated to impose a sanction on a violator, despite of the actual (in some cases mitigating) circumstances in relation to the issue.

 In accordance with the new edition of the law, if a broadcaster violates Georgian legislation or fails to fulfill a decision of GNCC, also, in the case of violation of licensing/authorization terms and conditions, the Commission is obligated to review the relevant issue and  if the violation is confirmed, is authorized to impose a sanction. The purpose of imposing a sanction on a broadcaster should be the prevention or elimination of a violation.
