GNCC has imposed a written warning upon “Magticom” for an improper and misleading commercial placement

GNCC has imposed a written warning upon “Magticom” Ltd for placing an improper and misleading commercial.

The Commission has begun proceedings in regards to the noted issue based on a request submitted by “Coalition for Media Advocacy.” In the commercial, “Magticom” offers consumers its services for broadcasting transit with following summary: “ Starting June 17, Georgia will transition into digital broadcasting and analogue broadcasting will be switched off, which means, that without special digital decoder you won’t be able to watch Georgian channels, do not wait until June 17, switch to Magtisat, make a transition into digital broadcasting today and watch the variety of Georgian and foreign channels, Magtisat-the first digital satellite broadcaster.”

After carefully reviewing the issue, Commission determined that a video commercial of “Magticom” is improper and misleading because it does not supply the potential consumer with full information about services, since, only part of the population who is receiving broadcasting via free-to-air broadcasting and at the same time is using relatively old modeled TV sets will not be able to watch Georgian channels “without special digital decoder.” However, part of the population that is using broadcasting transit services (cable operators) and/or uses modern TV set equipped with digital signal receiving support will not need special digital decoder and will continue to watch Georgian channels from June 17.

Based on above-mentioned, “Magticom” Ltd has been imposed with a written warning and was assigned to remove an improper and misleading commercial off the air.
