“Broadcasting Company Hereti”Ltd has been revealed as a winner in the contest announced to obtain radio broadcasting license

GNCC has executed the decision of the administrative panel of Tbilisi City Court and in accordance to the decision №403/10 made on June 21, 2013, “Broadcasting Company Hereti” was announced as a winning bidder in the contest for issuance of radio broadcasting license.

“Broadcasting Company Hereti” Ltd has become an owner of private general radio broadcasting license at FM93.5 in the Tbilisi broadcasting zone. According to the broadcasting concept presented by the company, radio “Hereti” will offer its listeners following themed broadcasting production: news, social-political program; analytical program; educational program; youth program; kids program; musical-entertaining and sports program.

According to the decision №403/10 made on June 21, 2013, in the beginning, “Energy Group” Ltd has been announced as a winner in the contest for the issuance of private general radio broadcasting license, although, on January 15, 2014, the Commission has invalidated the decision about revealing the winner company. The ground to begin administrative proceedings was based on a statement that has aired through mass media in November of 2013, and according to which, Kakha Baindurashvili -the founder and director of the “Energy Group” happened to appear the president of the Chamber of Commerce and Industry of Georgia at the same time (this information has been unknown to the Commission at the time of the contest). The Chamber of Commerce and Industry of Georgia is a Legal Entity of Public Law and therefore, represents administrative body. As for the president of this organization, he is an official of an administrative body. Georgian Law “on Broadcasting,” uniquely defines, that the licensees and/or their beneficiary owners in the field of broadcasting may not be an administrative body and/or the officials of administrative bodies.

Litigations have been in process in regard to the noted issue between “Broadcasting Company Hereti” and Commission and “Energy Group” and the Commission as well.  On June 12, 2015 the court issued a ruling on the termination of the trial in regard to the further discussion of the case, based on which, the Commission was ordered to re-examine documents submitted by the “Broadcasting Company Hereti” on June 21, 2013 by the decision №403/10 in the contest for issuance of private general radio broadcasting license. The Commission has satisfied the court order and has revealed “Broadcasting Company Hereti” as a winning bidder in the contest for issuance of private general radio broadcasting license.
