The Georgian National Communications Commission considered a complaint against the company Magticom Ltd at the session held today. The company Silknet submitted a request to the Commission.

According to the request Magticom Ltd distributes an advertising via its own web-site (www.magticom.ge) and TV, where Magticom Ltd proposes new tariffs to its subscribers, namely, for the subscribers of Magti, Bani, Bali and Magtifix the cost per minute - 1 tetri, that does not reflect the reality, because the call origination cost for the subscribers of Bani, Bali and Magtifix is 5 tetri, for the subscribers of Magti – 10 tetri. Besides, the subscriber’s monthly payment for this tariff is 1 GEL and there is no verbal expression about this in the advertising. The lettering corresponding to the real quantity of the tariff is shown in the end of the advertising and for a short time, which is not enough to perceive the information. According to Silknet, Magticom Ltd misleads its users as well as the consumers of other companies and thus does harm not only to consumers but also to the interests of other companies in this sphere. From Magticom’s side the above-mentioned is improper advertising, which is a breach of Law of Georgia on Advertising.

At the session the Georgian National Communications Commission listened to the positions of both companies and charged Magticom Ltd with placement of all the advertisings (broadcast advertising) distributed via TV in due form to be easily perceived by a major part of society (consumers).

The Commission explained to Magticom that the company should control and make corrections to all the advertisings placed on TV and radio before December 31, 2011. Listening to the advertising consumer shall have clear perception of the terms of proposed service. The Commission additionally explained that the advertising, upon its presentation, shall be instantly perceived by the majority of society.
