Issuance of licenses through auction for the use of radio spectrum in the electronic communications sector is implemented by Georgian National Communications Commission in accordance with the Law of Georgia on Electronic Communications. The license holder can be both individual and legal entity registered in Georgia as well as the individual entrepreneurs and legal entity registered abroad.

For the activities in the electronic communications sector, as well as those interested in obtaining a license for radiofrequency spectrum through supporting technological purposes in the broadcasting sector, shall submit application to the Commission. The application shall include the type of the application and it also must be accompanied by: extract from the register of business (non-commercial) legal entities, as for individuals - identification documents, copies of documents provided by the legislation of Georgia. The application of the legal entity of public law should include copies of incorporation documents.

Radio frequency spectrum license for digital terrestrial television network is issued through the competition according to the Law of Georgia on Electronic Communications.

Radio frequency spectrum license holder for digital terrestrial television network may be the citizen of Georgia or the resident of Georgia individual or legal entity.

Radio frequency spectrum license holder for digital terrestrial television network may not be the following:

a)      Administrative authority;

b)      Administrative body, officials, other public servants;

c)       Legal entity interdependent with the administrative authority;

d)      Political party, political party official;

e)      Offshore-registered entity;

f)       Legal entity whose shares are directly or indirectly owned by the offshore-registered entity.

In order to obtain radio frequency spectrum license for digital terrestrial television network the license applicant shall apply to the Commission with the competition application, where the following shall be indicated:

In case of individual - name, surname, place and date of birth, registration data, address, citizenship;

In case of legal entity - company name, legal form, legal address (seat), data registered at the register of business (non-commercial) legal entities.
