ComCom Cautions Sezoni TV for the Use of Offensive Language on Air
The Communications Commission has issued Sezoni TV with a written caution for violating the Georgian legislation. Monitoring activities carried out by the Commission established that in September this year, Sezoni TV aired the programme Daily Roundup with Nikoloz Mzhavanadze at 21:00, where obscene and offensive language was used both by the presenter and the guest.
According to the Law of Georgia on Broadcasting, programmes containing obscene and offensive language are inappropriate for minors under the age of 15. Therefore, the law imposes an obligation on the broadcaster to protect the interests of minors and not to air programmes unsuitable for minors between 18:00 and 23:00. Due to the fact that obscene and offensive language was used on the air of Sezoni TV at 21:00, the Communications Commission determined that the broadcaster violated the legislation.
Significantly, offensive language was used live on air. The Communications Commission therefore ruled that in order to prevent harmful effect on minors, the broadcaster was obliged to take reasonable measures, such as suspending the live broadcast or having the programme host prevent the guest from using offensive language. Instead, the host used offensive language himself, leading to the Commission deeming the broadcaster fully responsible.
Due to the fact that Sezoni TV had not been sanctioned for a similar violation in the last year, the Communications Commission issued the broadcaster with a written caution.
