ComCom Issues TV Formula with a Violation Report for Unlawful Assignment of Qualified Electoral Subject Status
The Communications Commission has deemed TV Formula to have violated the Election Code of Georgia and issued the broadcaster with and administrative violation report.
On 1 October, the Commission received a letter from TV Formula regarding the assignment of the status of a qualified electoral subject to the political union Gakharia for Georgia. According to the Election Code of Georgia, a broadcaster is authorised to recognise a political party as a qualified electoral subject, provided it enjoys the support of at least 4% of voters according to the results of at least 5 polls carried out in the election year, or 1 poll carried out 1 month before the elections. Furthermore, the broadcaster must verify that the polls in question have been carried out in accordance with the Election Code of Georgia. The letter sent by TV Formula included the results of 5 polls carried out by the polling organisation Edison Research this year, according to which Gakharia for Georgia had the support of more than 4% of the voters.
The broadcaster failed to present the appropriate information and documents to confirm that it had studied or verified the polls to establish their compliance with the legislation.
In light of the above, the Communications Commission ruled that TV Formula violated the Election Code of Georgia by unlawfully assigning the political union Gakharia for Georgia the status of a qualified electoral subject, and issued the broadcaster with and administrative violation report.
