ComCom Upholds the Complaint from Unity – National Movement against Teleimedi, PosTV and Studio Maestro
The Communications Commission has issued Teleimedi, PosTv and Studio Maestro with administrative violation reports for refusing to air the free political advertising of Unity – National Movement. Additionally, PosTV was found to have violated the Election Code of Georgia by unlawfully disseminating the results of a public opinion poll.
The Commission received a complaint from the political union Unity – National Movement, according to which, Teleimedi, PosTV and Studio Maestro have not aired the free political adverts submitted by the party since 10 October. Prior to 10 October, the broadcasters were airing the adverts as usual, but on that day, Teleimedi and PosTV publically announced that they would no longer place the political ads submitted by the opposition parties. Although no statement was made by Studio Maestro, the broadcaster stopped airing the video clip of Unity – National Movement at around the same time.
According to the Election Code of Georgia, a public broadcaster must allot, not later than the 50th day before the election day, in every three hours no less than 7.5 minutes to broadcast free of charge, the pre-election advertisements, and broadcast on the basis of equality and without discrimination, the pre-election advertisements submitted to it by each qualified electoral subject.
Furthermore, on 9 October, PosTV disseminated the results of a public opinion poll without specifying the person ordering the poll, and whether the poll was paid or free of charge. According to the Election Code of Georgia, when publishing public opinion poll results, the broadcaster must specify the person ordering the poll, the date of the poll, the polling method, the possible margin of error, and whether the poll is paid or free of charge, as well as the exact formulation of the questions used in the poll.
In light of the above, the Communications Commission has deemed Teleimedi, PosTV and Studio Maestro to have violated the Election Code of Georgia and issued them with administrative violation reports.
